1. Stories, ideas, suggestions, questions, essays, audio,video, photographs or related materials and any other materials of any kind whatsoever submitted (collectively, a “Submission”) will not be returned and will be treated as non-confidential and non-proprietary. We will not be liable for any use or disclosure of your Submission to anyone,including but not limited to, claimed intellectual property owners.
2. You hereby waive all “moral rights” in and to your Submission, even if your Submission is altered or changed in a manner that is not agreeable to you.
3. Upon your submission, you represent and warrant to TARAMARKUS.COM: that your Submission is an original work by you; you own or control 100% of the rights in and to your Submission; you have secured or cleared all rights related to persons and music contained therein and such rights are and shall be free and clear of anyand all claims, rights and obligations; all “moral rights” in your Submission have been waived. There should be no contract with any third party that could in any way interfere with TARAMARKUS.COM rights under this legal agreement or require any payment to be made to anyone by TARAMARKUS.COM.
4. TARAMARKUS.COM reserves the right not to use your Submission at all and/or as little of your Submission as TARAMARKUS.COM chooses; and to destroy and/or delete your Submission without any notice or liability to you.
5. You acknowledge and agree that it is possible that submissions similar to your Submission have been provided to TARAMARKUS.COM, or may in future be provided toTARAMARKUS.COM by multiple sources and that your Submission may be similar to ideas generated or developed independently by TARAMARKUS.COM team and its agency and that you shall have no right, action or claim against TARAMARKUS.COM with respect to its use of such a similar submission.
6. You agree to indemnify and hold harmless TARAMARKUS.COM from and against all claims, demands,loss, liability, damages and expenses (including legal fees and disbursements), including actions for infringement of copyright and any third party claim inconsistent with your grant of rights herein, or otherwise in connection with our use of your Submission under the terms of this agreement.
7. Upon your Submission, you represent and warrant that you are at least eighteen (18) years old.
8. You acknowledge and agree upon your Submission that you are not entering into an employment relationship with TARAMARKUS.COM and that no relationship is created other than a contributor agreement.
